Registration of Property: A Legal Safeguard for Ownership Rights

What is Property Registration?

Property registration is the legal process of recording property ownership with the government to establish a clear title. It ensures that the buyer’s rights are protected and prevents future disputes over ownership. Under the Registration Act, 1908, all property transactions must be registered to be legally valid.

Why is Property Registration Important?

Legal Proof of Ownership – Confirms the buyer as the legal owner of the property.
Prevents Fraud – Reduces the risk of illegal claims or fraudulent transactions.
Marketability & Transferability – Makes it easier to sell or transfer property in the future.
Admissible in Court – Acts as strong legal evidence in case of disputes.
Government Compliance – Ensures adherence to property laws and tax regulations.

Steps Involved in Property Registration

1. Verification of Property Documents

  • Sale Deed (Primary document)
  • Encumbrance Certificate (Confirms no pending legal dues)
  • Approved Layout and Building Plan
  • Khata Certificate (for municipal records)
  • Property Tax Receipts

2. Stamp Duty & Registration Fee Payment

  • Stamp Duty: A percentage of the property value, varies by state.
  • Registration Fee: Usually 1% of the total property value.

3. Execution of Sale Deed

  • The buyer and seller sign the sale deed in the presence of witnesses.
  • The deed must be printed on stamp paper of the required value.

4. Submission at the Sub-Registrar’s Office

  • The sale deed is submitted for registration along with identity and address proof.
  • Biometric verification and digital photographs are taken.

5. Issuance of Registered Sale Deed

  • After verification, the registered sale deed is issued to the buyer.
